Chapter 13 allows a debtor to keep property and pay debts over time, usually three to five years.  We use a budget based repayment plans within your budget to do this.

Questions to ask yourself are:

  • Do you owe state or federal taxes?
  • Are you behind on your mortgage or vehicle payments?
  • Have you received a sheriff sale notice on your home?
  • Do you have a prior bankruptcy within the past 8 years?

Commonly Asked Questions Regarding Bankruptcy

  • Document Checklist

    • Name, address, account number and balance from all people or places you owe money (either a list or statements). 
    • If you have been sued in the past year I need documents showing the caption of the law suit.
    • If you have a notice of entry and judgment document, I need that. 
    • Two most recently filed state and federal tax returns or tax transcript from the IRS.
    • Credit Counseling Certificate from debtorcc.org or any other approved agency.
    • Legal description of your home from a deed or abstract (not from a tax statement).
    • Vehicle titles, mileage, loan information and approximate market value.
    • Bank information and inventory for any safe deposit boxes.
    • Recent statement showing the blance of any pension or retirement accounts. 
    • A brief description of any life insurance policies you have. 
    • Addresses you have had for the past three years.
    • Paystubs for each paycheck you receive during the full six months prior to the time that you came in plus the current paystubs for the month in which you file.
